Terms of Service
Version 2026-10-v1 - Effective October 2026
1. Agreement
These Terms of Service (the “Terms”) govern your access to and use of the GenuineSender hosted DMARC authentication platform (the “Service”). By creating an account, clicking to accept these Terms, or subscribing to the Service, you agree to be bound by these Terms. If you accept on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Scope of Service
GenuineSender provisions and hosts DNS DMARC authentication policies (v=DMARC1) and delivers related telemetry and reporting. The Service is an infrastructure authentication control. It is not an inbox firewall, spam filter, secure email gateway, or a guarantee against human error, social engineering, or business email compromise. Enforcing a p=reject policy instructs receiving mail systems to reject unauthenticated mail that claims to originate from your domain; it does not validate the intent or legitimacy of authenticated senders.
3. Customer Responsibilities
- You are responsible for maintaining the DNS records required for the Service, including the hosted _dmarc CNAME, and for ensuring your legitimate senders are SPF/DKIM aligned before enforcement.
- You are responsible for reviewing any pre-enforcement sender-alignment hold notice before approving Maximum Lock enforcement.
- You will not use the Service to send unsolicited bulk email or to violate any applicable law.
4. Limitation of Liability & Damages Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENUINESENDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM WIRE FRAUD, INVOICE INTERCEPTION, OR BUSINESS EMAIL COMPROMISE (BEC).
UNDER NO CIRCUMSTANCES SHALL GENUINESENDER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE SUBSCRIPTION FEES ACTUALLY PAID BY THE CUSTOMER TO GENUINESENDER DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This cap applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if GenuineSender has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
5. Subscriptions & Billing
Subscriptions are billed in advance on a monthly or annual basis via Stripe. Annual plans are billed upfront at a discounted rate equivalent to two months free. Applicable taxes are calculated and collected automatically. You may cancel at any time; cancellation is scheduled at the end of the current paid period.
6. Cancellation, Offboarding & Dangling DNS
When a subscription ends, GenuineSender removes the hosted DMARC record. Your registrar will then still point _dmarc at a now-deleted record (a “dangling” CNAME). You are responsible for removing that record from your registrar to avoid deliverability penalties. GenuineSender sends a cleanup notice with each offboarding.
7. Compliance Certificates
The ISO-style Compliance Certificate attests to live DNS enforcement at the verification time shown on the certificate. It is corroborating evidence for underwriters, not a warranty of security outcomes. Certificates are suspended or revoked if the domain shield is disconnected.
8. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.
